These terms and conditions are the terms on which we (Alone in the Bath) sell all goods, and they will apply to the purchase of any goods by you (the customer) on this website.
Please read these terms and conditions to make sure you are happy to place an order with Alone in the Bath and hereby make a legally enforceable agreement.
By ordering any goods the customer agrees to be bound by these terms and conditions. Customers can only purchase from this website if eligible to enter into a contract and are at least 18 years old.

PERSONAL INFORMATION
Alone in the Bath retain and use all personal information strictly under the privacy policy.
We may contact you by using e-mail or other electronic communication methods and by pre-paid post and you expressly agree to this.
These Terms and Conditions should be read alongside, and are in addition to our policies, including our privacy policy.

BASIS OF SALE
The description of the Goods in the Alone of the Bath website is not a legal contractual offer to sell the Goods. Alone in the Bath reserve the right to cancel or suspend any order, if we believe a customer acts against these Terms and Conditions.
It is the customer's responsibility to check and amend any errors during the ordering process before submitting the order.
Once a purchase is made the customer will receive a confirmation email from Alone in the Bath forming a contract of sale. The customer must make sure that the order confirmation is complete and accurate and inform Alone in the Bath immediately of any errors.
No variation of the Contract, whether about description of the goods, fees or otherwise, can be made after it has been entered into unless the variation is agreed by the customer and Alone in the Bath in writing.
The customer does not own the goods until Alone in the Bath have received payment in full.
By ordering from our website, the customer agrees not to commercially resell any of our products. Commercially reselling our products is a breach of these terms and conditions and the customer's agreement with Alone in the Bath.

PRICE AND PAYMENT
The price of the goods and any additional delivery or other charges is that set out on the Alone in the Bath website at the date of the order.
Prices and charges include VAT at the rate applicable at the time of the order.
Payment will be set in GB pounds (£), and if applicable, your card will be charged according to the exchange rate at that time.
The customer must pay by submitting their credit or debit card details their order and Alone in the Bath can take payment immediately or otherwise before delivery of the goods. The payment is processed through the Wix secure server. Alone in the Bath do not hold the customer's credit card data.

CUSTOMS
If Alone in the Bath accept an Order for delivery outside England and Wales, Scotland, Northern Ireland, the Isle of Man and Channels Islands, the customer may need to pay import duties or taxes, fees, levies or other charges as a result of local legislation, as we will not pay them. We advise that you check the import charges applicable before ordering Products to be delivered there.

DELIVERY
Alone in the Bath will deliver the goods to the delivery address within the agreed period or, in the UK, not more than 30 days after the day on which the order was placed.
If Alone in the Bath do not deliver the goods on time (regardless of events beyond Alone in the Bath's control*), the customer can treat the contract as cancelled in the following cases:
Alone in the Bath have refused to deliver the goods; or
Alone in the Bath have not delivered the goods within the agreed period.
If the customer treats the contract as cancelled, Alone in the Bath will promptly return all payments made under the contract.
If the customer was entitled to treat the contract at an end, but does not do so, the customer is not prevented from cancelling the order for any goods or rejecting goods that have been delivered and, as a result, Alone in the Bath will without delay return all payments made under the contract for any cancelled or rejected goods. If the goods have been delivered, the customer must return them to Alone in the Bath or allow Alone in the Bath to collect them and Alone in the Bath will pay the costs of this.
The customer agrees Alone in the Bath may deliver the goods in instalments if Alone in the Bath suffer a shortage of stock or other genuine and fair reason, and the customer will not be liable for extra charges.
If the customer fails, through no fault of Alone in the Bath, to take delivery of the goods at the delivery Location, Alone in the Bath may charge the reasonable costs of storing and redelivering the goods.
* Events beyond our control:
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event).
A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes but is not limited to:
- Strikes or other industrial action.
- Fire, explosion, adverse weather conditions, subsidence, epidemic or other natural disaster.
- Disruption to supplies or delivery means.
- Acts of government or regulatory bodies.
- Disruption to public or private telecommunications networks.
- Civil commotion, terrorism or threat of, war or threat or preparation for.
- Parcels going overseas may be delayed at customs control when entering the destination country. This is beyond Alone in the Bath's control and we cannot be responsible for the late arrival of parcels detained at customs.

DAMAGE/LOSS
The goods will become the customers' responsibility from the completion of delivery or customer collection. The customer must, as reasonably practicable, examine the goods before accepting them.
Risk of damage or loss of any goods will pass to the customer when the goods are delivered to them.
WITHDRAWAL, RETURNS AND CANCELLATION
The customer has the right to cancel their contract with Alone in the Bath and receive a full refund. The Customer has 14 calendar days from the day on which their order is delivered to notify Alone in the Bath that they wish to cancel, and the customer may do so by contacting Alone in the Bath at info@aloneinthebath.com.
The customer must be able to show clear evidence of when the cancellation was made.
If the contract is cancelled in full after the goods were shipped, unless faulty or not as described, the customer must return the goods to Alone in the Bath, and Alone in the Bath will provide the customer with a refund for the item(s). In such cases, the customer will be responsible for the cost of returning the goods to us. The customer also has a legal obligation to keep the products in their possession and to take reasonable care of the products while they are in their possession;
Any item being returned must be unused, in its original condition including packaging and labelling. If the customer does use the item or remove / tamper with the tags or packaging, they will lose their right to return the goods under our returns policy.
Alone in the Bath will make the reimbursement without undue delay, and not later than:
14 days after the day Alone in the Bath receive back from the customer any goods supplied, or
(if earlier) 14 days after the day the customer provides evidence that they have sent back the goods.
Delivery and return costs are not refundable.
If the contract is cancelled in full before the goods were shipped, Alone in the Bath will provide the customer with a refund for the item(s) and delivery charge within 14 days of cancellation receipt.

DAMAGED GOODS
In the event of a damaged parcel, if the customer sends the products back to Alone in the Bath within 14 days of receiving them, we will offer an exchange where possible, or a full refund after we have received the return. In this case, we will pay for the postage of sending these items back to us.

YOUR STATUTORY RIGHTS
The above policy does not affect your statutory rights including your rights in relation to faulty goods or your right to cancel orders made online.
These terms are governed by English law and the courts of England and Wales shall have non-exclusive jurisdiction.

LIABILITY
Wax products must be kept out of reach of children and pets. Every bath bomb/bath fizzy order will include a card with usage instructions that should be read by the customer prior to using the product. The ingredients are listed on the website and on the labels of the products and it is the customer's responsibility to read them before ordering/using our products.
To the maximum extent permitted by applicable law, in no event shall Alone in the Bath, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service. To the maximum extent permitted by applicable law, Alone in the Bath assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

THE RIGHT TO CHANGE AND MODIFY TERMS
Alone in the Bath reserve the right to modify these terms from time to time at our sole discretion. Therefore, customers should review this page periodically. When we change the Terms in a material manner, we will notify the customers that material changes have been made to the Terms. Your continued use of the website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the terms, do not use or access (or continue to access) the website or the service.
